Terms & Conditions of Service
By engaging Stoked Electrics to provide goods and/or services, the Client acknowledges that they have read and accepted these Terms and Conditions.
1. Definitions
Stoked Electrics means Stoked Electrics and its successors and assigns.
Client means the person, company, or authorised representative requesting the supply of Goods and/or Services.
Goods means any materials, products, equipment, or components supplied by Stoked Electrics.
Services means all electrical, air conditioning, installation, maintenance, repairs, testing, fault-finding, and associated works carried out by Stoked Electrics.
Quotation means any written estimate provided by Stoked Electrics.
Price means the amount payable by the Client for the Goods and/or Services, including GST.
2. Quotations and Variations
2.1 Quotations are valid for 30 days unless otherwise stated.
2.2 Quotations are based on visible site conditions and the information provided by the Client. Hidden defects, inaccessible areas, or unforeseen circumstances may require additional work and may result in a variation to the quoted price.
2.3 Any additional work requested by the Client or required to complete the project safely and in accordance with applicable standards will be charged at Stoked Electrics' current rates.
2.4 Acceptance of a quotation constitutes acceptance of these Terms and Conditions.
3. Pricing and Payment
3.1 Payment is due upon completion of works unless otherwise agreed in writing.
3.2 Commercial account customers approved for credit must pay invoices in accordance with their agreed trading terms.
3.3 Deposits may be required for larger projects, custom materials, or special-order equipment.
3.4 Overdue accounts may incur interest and recovery costs, including legal and collection fees.
3.5 Ownership of materials supplied remains with Stoked Electrics until payment has been received in full.
4. Access to Site
4.1 The Client must provide safe and unrestricted access to the work area.
4.2 Delays caused by restricted access, other trades, or circumstances outside Stoked Electrics' control may result in additional charges.
4.3 If work is postponed or rescheduled by the Client after materials have been ordered or labour allocated, cancellation or rescheduling fees may apply.
5. Supply and Installation
5.1 Stoked Electrics will make every effort to complete work within estimated timeframes but is not liable for delays caused by suppliers, weather, power outages, availability of products, or other circumstances beyond its control.
5.2 Work may be completed in stages where necessary.
5.3 Any dates provided are estimates only and do not constitute a guarantee.
6. Existing Conditions and Hidden Defects
6.1 Stoked Electrics is not responsible for faults, damage, or non-compliant installations that are hidden or not visible during the initial inspection.
6.2 If unsafe wiring, asbestos, damaged cabling, switchboards, or other defects are discovered, work may be suspended until the issue is rectified.
6.3 Additional charges may apply where unforeseen conditions are encountered.
7. Damage and Restoration
7.1 Reasonable care will be taken to minimise disturbance to walls, ceilings, floors, gardens, paving, and other finishes.
7.2 Unless specifically included in the quotation, plaster repairs, painting, landscaping, tiling, rendering, and other restoration work are excluded.
8. Warranties
8.1 Manufacturer warranties apply to products and equipment supplied by Stoked Electrics.
8.2 Stoked Electrics warrants workmanship for twelve (12) months from the date of installation unless otherwise stated.
8.3 Warranty claims do not cover:
Misuse or neglect.
Damage caused by other trades or third parties.
Power surges, storms, flooding, vermin, or acts of nature.
Alterations or repairs carried out by others.
9. Limitation of Liability
9.1 To the extent permitted by law, Stoked Electrics' liability is limited to:
Repairing defective workmanship;
Replacing faulty materials; or
Re-supplying the Services.
9.2 Stoked Electrics will not be liable for any indirect, consequential, or economic loss including loss of profits, loss of business, or loss arising from delays.
10. Ownership of Materials
10.1 Ownership of all materials supplied remains with Stoked Electrics until payment has been made in full.
10.2 Stoked Electrics reserves the right to recover unpaid materials where legally permitted.
11. Cancellations
11.1 Orders may only be cancelled with the written approval of Stoked Electrics.
11.2 Any materials already purchased or labour committed may be charged to the Client.
12. Force Majeure
Stoked Electrics will not be liable for delays or failure to perform due to events beyond its reasonable control, including:
Severe weather;
Natural disasters;
Supplier shortages;
Industrial disputes;
Government restrictions;
Power outages;
Acts of God.
13. Insurance
Stoked Electrics maintains appropriate insurances including:
Public Liability Insurance;
Workers Compensation Insurance;
Any other insurances required by law.
Certificates of Currency are available upon request.
14. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Victoria.
